Legal team submits 2 communications to ICC over Israeli crimes against Palestinians

The legal team representing Palestinian victims and several civil society organizations has submitted two official communications to the Office of the Prosecutor of the International Criminal Court (ICC), as part of the ongoing investigation into the situation in the State of Palestine.

The first communication addresses crimes committed against Palestinian prisoners and detainees by the Israeli occupying authorities. It documents acts of ill-treatment, inhumane conditions of detention, torture, and systematic violations of fundamental rights guaranteed under international humanitarian law and international human rights law.

The second communication concerns the deliberate use of starvation as a method of warfare against the population of Gaza. These acts, carried out in a widespread and systematic manner against civilians, may amount not only to war crimes and crimes against humanity, but also to the crime of genocide, due to their premeditated nature and the apparent intent to destroy, in whole or in part, a national, ethnic, racial, or religious group.

The legal team held a detailed meeting with members of the investigative team responsible for the situation in Palestine. The exchange was cooperative, constructive, and marked by a high degree of professionalism.

At the conclusion of the meeting, the lawyers reaffirmed their full support for the International Criminal Court and its staff, particularly in light of the threats and unlawful measures being directed against the institution.

The team of lawyers, committed to representing Palestinian victims and civil society organizations, aims to carry out its work not only as a moral duty but in strict adherence to the highest ethical standards of the legal profession.

The team remains firmly committed to defending the rights and interests of the victims and contributing to the fight against impunity, in accordance with international law and the principles of international criminal justice.

Recall that South Africa took Israel to the International Court of Justice on 29 December, 2023 over Israel’s conduct in the Gaza Strip during the Gaza war, which resulted in a humanitarian crisis and mass killings.
